Marriage Visa Pathways We Handle

The right immigration route depends on where the foreign spouse currently lives, the sponsor’s immigration status, and how the relationship has progressed. We work with Raleigh couples across every marriage-based pathway.

K-1 Fiancé Visa

If you’re a U.S. citizen engaged to a foreign national living abroad, the K-1 fiancé visa allows your partner to enter the United States specifically to marry. After arrival, K-1 holders must obtain a marriage license from the Wake County Register of Deeds and marry within 90 days. The next step is filing Form I-485 (Application to Register Permanent Residence) to pursue the green card.

CR-1 & IR-1 Spouse Immigrant Visas

Already married with your spouse living abroad? Consular processing through a CR-1 or IR-1 immigrant visa begins with Form I-130 (Petition for Alien Relative) filed with USCIS. Spouses of U.S. citizens are classified as immediate relatives and aren’t subject to annual visa caps, which generally means faster movement than cases involving lawful permanent resident sponsors. If the marriage is less than two years old when the visa is issued, USCIS grants a conditional green card (CR-1) valid for two years. Removing those conditions requires a timely Form I-751 filing.

Adjustment of Status

When the foreign-national spouse is already present in the U.S. on a lawful entry, adjustment of status lets the couple pursue permanent residence without consular processing abroad. U.S. citizen sponsors can file Form I-130 and Form I-485 concurrently, which can reduce the overall timeline. Spouses of lawful permanent residents fall under the F2A preference category and are subject to visa availability based on the State Department’s monthly visa bulletin.

VAWA-Based Permanent Residency

The Marriage Visa Process: What to Expect

Nearly every marriage-based case begins with Form I-130 to establish the marital relationship with USCIS. For K-1 cases, Form I-129F is filed first. From that starting point, we manage the full process: document preparation, petition filing, USCIS communication, and interview preparation.

Building Your Bona Fide Marriage Record

USCIS requires evidence such as joint bank accounts, shared lease or mortgage documents, photographs together, and affidavits from people who know the couple. An Affidavit of Support (Form I-864) is also required, demonstrating the sponsor’s financial ability to support the foreign-national spouse at 125 percent of the federal poverty guidelines. Adjustment of status applicants must also complete a medical exam by a USCIS-approved civil surgeon.

Interviews, Timelines, & Requests for Evidence

For adjustment of status cases, the USCIS interview takes place at the field office serving the Raleigh area, and we prepare clients thoroughly for it. General processing timelines vary: adjustment of status for spouses of U.S. citizens typically runs approximately 10 to 18 months from filing to interview; consular processing abroad generally takes 12 to 24 months depending on the embassy and case specifics. These are approximate ranges, subject to change based on current USCIS backlogs and policy. If USCIS issues a Request for Evidence (RFE) because documentation is incomplete, responding promptly and completely is essential. We handle that response with you directly, not through layers of staff.
